Prosecutors in Avellino have requested two convictions in the trial over the bankruptcy of Mo.Se. Spa, the in-house company of the Municipality of Montemiletto, while requesting dismissal or acquittal on all charges for former mayor Eugenio Abate.
The requests were presented before the Avellino Collegiate Court, chaired by Gian Piero Scarlato, with Pierpaolo Calabrese and Lorenzo Corona serving as associate judges. The case concerns seven alleged offenses connected to the failure of the municipal company.
According to the prosecution, no active participation by Abate in Mo.Se. Spa's management decisions had emerged, leading prosecutors to seek his dismissal or acquittal on every allegation against him.
The prosecution also sought acquittals for all defendants on the alleged forms of improper bankruptcy.
The requested convictions involve Egidio Raffaele and Boccia in connection with the alleged asset-related bankruptcy offense linked to the outsourcing of Mo.Se. Spa's front-office claim-management service to Mose Società Cooperativa Onlus. For both defendants, prosecutors requested two-year suspended sentences, citing their lack of prior convictions.
The proceedings were expected to continue with the defense phase and a possible judgment on 1 December.
These remain prosecutorial requests, not a final judgment by the court.
