The Tribunale di Benevento has dismissed the bankruptcy case against a 53-year-old entrepreneur from Montesarchio, ruling that the charge was extinguished by the statute of limitations.
The businessman had initially been accused of fraudulent bankruptcy. According to the prosecution, in his role as administrator and liquidator of a bankrupt company, he allegedly removed or failed to hand over part of the company's books and accounting records.
The disputed documentation covered, among other periods, 2013–2014 and included corporate books, minutes, inventories, financial statements, the general journal and VAT registers.
The court reclassified the conduct as simple documentary bankruptcy and declared the offence extinct due to intervening prescription. In doing so, it accepted the argument put forward by defence lawyer Vittorio Fucci.
