The trial over the violence reported at the Santa Maria Capua Vetere prison on 6 April 2020 has entered the final stage of defense arguments. In the latest phase of the large-scale proceeding, the defense of Anna Rita Costanzo argued that intense media exposure may have affected the statements, memories, and identifications made by some detainees.
That claim remains a defense argument, not an established finding. The question of individual responsibility is still before the court, and the sources consulted do not report a final judgment in the main trial.
What the defense argued
According to the reported closing argument, Costanzo's defense contended that widespread press and television coverage could have influenced how detained witnesses recalled events and identified prison staff.
The defense also raised the possibility of mistaken identity in some identifications. In that context, the lawyers referred to footage from the social rooms and maintained that the images did not show Costanzo holding a baton.
Surveillance video and witness testimony are among the elements discussed by the parties during the proceeding.
Prosecution requests and chain of command
Separately, the public prosecutor has sought convictions for numerous defendants, with reported requested sentences ranging from 7 to 21 years. The requests concern the events in the prison and responsibility within the administrative and prison-police chain of command.
Those requests are prosecutorial positions. They do not establish guilt, and the final assessment belongs to the court.
Rights of defendants and criticism of media exposure
The Unione delle Camere Penali has distinguished between judicial ascertainment of the violence and protection of defendants' rights. It called for rapid clarification of the facts while criticizing the media circulation of photographs and video before adversarial examination, recalling the presumption of innocence.
That broader debate provides useful context for the current defense line: the defense is challenging the reliability of some testimony allegedly exposed to media influence, while the criminal lawyers' association had earlier warned against the spectacular presentation of the investigation.
A separate track in Cassation
For two officers tried under the abbreviated procedure, CasertaNews reported that the Court of Cassation annulled their acquittal on appeal and ordered a new examination before a different section of the Court of Appeal.
The reasoning for that Cassation decision was not yet available in the consulted source. The outcome of that separate track should therefore not be confused with the main trial, which remains without a reported definitive sentence.
What remains undecided
Several points remain open:
- Whether media exposure actually altered testimony has not been established from the consulted sources; it is the thesis advanced by the defense.
- The reconstruction of individual responsibility remains a matter for judgment and cannot be presented as definitively established.
- No final judgment in the principal large-scale trial is reported in the consulted sources.
- The reasoning behind the Cassation ruling concerning the two officers was not yet available.
The next steps belong to the court, which must weigh surveillance images, testimony, defense objections about media influence and identification, and the prosecution's sentencing requests before reaching its conclusions.
